Terms and Conditions

1. Who may use the service

Anyone may browse. To create an account for a child under 13, you must be that child's parent or legal guardian, and the account is yours — the child uses a profile under it. Students aged 13 and over may register for themselves.

2. What the service is

TalkingPencil provides supplementary learning material. It is not school teaching material, not a substitute for schooling, and not affiliated with the Education Bureau, the Hong Kong Examinations and Assessment Authority, or any textbook publisher.

Content is generated by software and artificial intelligence and verified by automated processes. We work hard on accuracy and we do not guarantee it. We make no promise about examination results.

3. Your account

• ·Give accurate information when registering, and keep your password to yourself.
• ·You are responsible for what happens under your account, including your children's profiles.
• ·Tell us promptly if you think someone else has got into your account.
• ·One account per person. Do not share accounts or resell access.

4. Acceptable use

Use the service for learning. Do not scrape, bulk-download or republish our questions; do not attempt to extract answer keys; do not interfere with the service or with other users; do not use the service to break the law.

5. Subscriptions

Paid plans are not yet available. When they are, this section will set out prices, billing cycle, free-trial terms, renewal and cancellation. Cancelling will always be possible from inside your account, without contacting us.

6. Our content and yours

The questions, explanations, software and design are ours (see Copyright and Notices). You get a personal, non-transferable licence to use them for learning. Anything you submit — a problem report, a message — you allow us to use to improve the service.

7. Availability and changes

We may change, suspend or withdraw parts of the service. Where a change materially affects you — particularly a paid plan — we will give notice. We may update these terms; the date at the top shows when they last changed, and continued use after a change means you accept it.

8. Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, or for decisions made in reliance on the content — including academic decisions. Nothing here limits liability that cannot lawfully be limited.

9. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the Hong Kong courts have jurisdiction.
